Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Solaksinvest platform ("Platform," "Service"), operated by Solaksinvest ("we," "us," "our"), a company based in Norway.

By creating an account or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws — including Norwegian law, EU law, and the General Data Protection Regulation (GDPR).

If you do not agree to these Terms, do not use the Platform.

2. Eligibility

  • You must be at least 16 years old to use the Platform.
  • By using the Platform, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
  • If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

  • You may register using email and password, or via third-party OAuth providers (Google, X/Twitter).
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information during registration.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at contact@solaksinvest.com if you suspect unauthorized access.

4. The Service

Solaksinvest provides:

  • Charting and technical analysis tools
  • Custom indicators and backtesting
  • Trade tracking and journaling
  • Collaborative features: shared charts, teams, social features, and live sessions
  • Chart sharing via links and social media

The Platform is a tool for analysis and education. It is not a financial advisory service, brokerage, or investment platform.

5. No Financial Advice

Nothing on this Platform constitutes financial, investment, tax, or legal advice.

  • All content, indicators, signals, and tools are for informational and educational purposes only.
  • Trading financial instruments involves substantial risk, including the risk of losing your entire investment.
  • Past performance is not indicative of future results.
  • You are solely responsible for your own trading decisions.
  • We strongly recommend consulting a qualified financial advisor before making any investment decisions.

This disclaimer is in accordance with Directive 2014/65/EU (MiFID II) and the Norwegian Securities Trading Act (Verdipapirhandelloven). We do not hold any financial services license and do not provide regulated investment services.

6. User Content and Data

6.1 Your Content

You retain ownership of all content you create on the Platform (charts, drawings, trade entries, messages, etc.). By using collaborative features (sharing, teams), you grant us a limited, non-exclusive license to store, display, and transmit that content as necessary to provide the Service.

6.2 Shared Content

When you share a chart via link, social media, or team channels, the shared content becomes visible to the intended recipients. You are responsible for what you share.

6.3 Data Processing

Your personal data is processed in accordance with our Privacy Policy, GDPR, and the Norwegian Personal Data Act (Personopplysningsloven).

7. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Interfere with, disrupt, or compromise the security or integrity of the Platform
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated scripts, bots, or scrapers to access the Platform without our written consent
  • Distribute malware, spam, or harmful content through the Platform
  • Harass, threaten, or abuse other users
  • Impersonate any person or entity
  • Use the Platform to provide regulated financial services without proper authorization
  • Reverse-engineer, decompile, or extract source code from the Platform

We reserve the right to suspend or terminate accounts that violate these rules.

8. Intellectual Property

  • The Platform, including its design, code, indicators, and branding, is owned by Solaksinvest and protected by copyright and intellectual property law.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial use (or as permitted by your subscription).
  • You may not copy, modify, distribute, or create derivative works from our proprietary indicators, tools, or platform code.

9. Availability and Modifications

  • We aim to provide continuous access to the Platform but do not guarantee uninterrupted availability.
  • We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
  • Planned maintenance will be communicated in advance where feasible.
  • We are not liable for any loss resulting from downtime or service modifications.

10. Limitation of Liability

To the maximum extent permitted by applicable law, including the Norwegian Marketing Control Act (Markedsføringsloven) and EU consumer protection directives:

  • The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Platform will be error-free, secure, or uninterrupted.
  • We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform.
  • We are not liable for any trading losses, financial losses, or investment decisions made using or based on the Platform.
  • Our total aggregate liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

Note: Nothing in these Terms limits or excludes liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.

11. Indemnification

You agree to indemnify and hold harmless Solaksinvest, its officers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

12. Termination

  • You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
  • We may suspend or terminate your access if you violate these Terms, with notice where practicable.
  • Upon termination, your license to use the Platform is revoked. Sections that by their nature should survive (liability, indemnification, governing law) will continue to apply.

13. Consumer Rights

If you are a consumer within the European Economic Area (EEA) or Norway, you have rights under the Consumer Rights Directive (2011/83/EU), the Norwegian Consumer Purchases Act (Forbrukerkjøpsloven), and the Norwegian Right of Withdrawal Act (Angrerettloven).

  • You may have the right to withdraw from a paid subscription within 14 days of purchase ("right of withdrawal"), unless the digital service has been fully provided with your prior express consent.
  • Nothing in these Terms affects your statutory consumer rights under applicable law.

14. Governing Law and Disputes

  • These Terms are governed by and construed in accordance with the laws of Norway.
  • Any disputes arising from these Terms shall be resolved by the courts of Norway, with Oslo as the legal venue.
  • If you are a consumer in the EEA, you may also bring proceedings in the courts of your country of residence.
  • You may also submit complaints to the Norwegian Consumer Authority (Forbrukertilsynet) or use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you disagree, you may terminate your account.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
